CNJ restores registration RL MGSaturday April 20th, 2013
The National Council of Justice has acknowledged, on Friday (19/4), the request of the Public Ministry of Minas Gerais, who defended the requirement for registration of legal reserve areas in the state. The injunction of the CNJ repealing Ordinance 01/2003 of Internal Affairs of the mining Court, which dispensed with the registration of land by the land registry.
In the opinion of MP-MG, the measure represented a serious threat to the environment by the lack of public control of the areas protected by environmental legislation. The coordinator of the Operational Support Center of the Prosecutor for Environmental Defense Attorney of Justice Alceu José Torres Marques, points out that the “injunction granted by CNJ through counselor rapporteur Neves Amorim, will have a material impact on the state of Minas Gerais, especially in relevant protected areas for biodiversity conservation. ”
With the publication of the New Forest Code, the registration of the legal reserve area of real estate has become optional for the owner since the area was registered in the Rural Environmental Registry. The operation of this new registration tool is expected to start by the end of the first half of 2013.
